§1 Legal Terms

  1. Business days - days from Monday to Friday, except public holidays according to the Polish public holiday calendar.
  2. Store - elfjoy online store ran by the Seller at https://elfjoy.com.
  3. Account - a free Store function regulated by separate regulations (a service provided electronically), thanks to which the Buyer can set up his individual account in the Store.
  4. Customer / Buyer – each entity buying in the Store.
  5. Consumer – an adult natural person with full legal capacity or an adult natural person running a sole proprietorship, concluding an agreement with the Seller directly related to his business or professional activity, but not having a professional nature for him.
  6. Privileged Customer – Privileged Consumer or Entrepreneur.
  7. Privileged Entrepreneur - a person concluding an agreement with the Seller directly related to his business activity, but not having a professional nature for him (the definition applies to contracts concluded from 1 January 2021).

  9. Seller / Service Provider - KATARZYNA KUCHARSKA, an entrepreneur running a business under the name of "elfjoy Katarzyna Kucharska", entered into the Central Register and Information on Economic Activity kept by the Minister od Economy and keeping the Central Register and Information on Economic Activity, TIN 1180524129, REGON 142674530, address ul. Tamka 36, 00-355 Warsaw.
  10. Delivery - the type of transportation service along with the specification of the carrier and its cost - listed in the "delivery and returns" tab.
  11. Proof of purchase - an invoice, bill or receipt issued in accordance with the Goods and Services Tax Act of March 11, 2004, as amended, and other applicable laws.
  12. Product page - a single subpage of the store containing information about a single product.
  13. Civil Code - the Civil Code Act of April 23, 1964, as amended.
  14. Code of good practice - a set of rules of conduct, in particular ethical and professional standards referred to in Art. 5 of the Act on Counteracting Unfair Market Practices of August 23, 2007, as amended.
  15. Shopping Cart / Cart - a list of products gathered from the products available in the Store based on the Buyer's choices.
  16. ODR Internet Platform – an EU website operating on the basis of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22 / EC and available at https://ec.europa.eu/consumers/odr/
  17. Payment - the method of payment for the subject of the contract and the delivery listed on the payment page.
  18. Consumer law - the Act on consumer rights of 30 May 2014.
  19. Product - the minimum and indivisible number of items that may be the subject of the order, which is given in the Seller's store as a unit of measurement when determining its price (price / unit).
  20. Subject of the contract - products and delivery being the subject of the Contract.
  21. Subject of the service - subject of the contract.
  22. Collection point - the place of delivery of the item, which is not a postal address, listed in the statement made available by the Seller in the store.
  23. Register of UOKiK - register of authorized entities kept by the Office of Competition and Consumer Protection pursuant to the Act on out-of-court resolution of consumer disputes of September 23, 2016, as amended, and available at: https://uokik.gov.pl/relog_podmiot_uprawacyjnych. php
  24. General Data Protection Regulation / GDPR – Regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Data Protection Directive).
  25. Item - a movable item that may be or is the subject of the contract.
  26. Privacy Policy - the rules on processing of the Buyers 'personal data by the Personal Data Administrator, Buyers' rights and obligations of the Data Administrator, which can be found on the privacy policy page.
  27. Order completion date - the number of hours or business days specified on the product card.
  28. Contract - an agreement concluded outside the business premises or at a distance within the meaning of the Act on Consumer Rights of May 30, 2014 in the case of Consumers and a Sales Contract within the understanding of Art. 535 of the Civil Code Act of April 23, 1964 in the case of Buyers.
  29. Flaw – both a physical flaw as well as a legal flaw.
    1. Physical flaw– non-compliance of the product sold under the contract, in particular if the product:
      1. Does not have the physical properties that the item should have according to the purpose specified in the contract or resulting from circumstances or destination;
      2. does not have the physical characteristics which the Seller assured the Customer for the Product to have;
      3. it is not suitable for its intended use of which the Customer was informed by the Seller at the conclusion of the Contract, and the Seller did not raise any objections as to changes in its intended use;
      4. was delivered to the Client incomplete;
      5. in the event of improper installation and commissioning, if these activities were performed by the Seller or a third party for which the Seller is responsible, or by the Customer who followed the instructions received from the Seller;
      6. it does not have the physical properties provided by the Seller or his representative or the person who places the item on the market within the scope of his business activity, and the person who, by placing his name, trademark or other distinctive sign on the item sold, presents himself as the manufacturer, unless the Seller knew these assurances or, judging reasonably, could not know or could not have influenced the Customer's decision to conclude the contract, or if their content was corrected prior to the conclusion of the contract.
        2. Legal flaw - a situation where the item sold is the property of a third party or is encumbered with the right of a third party, and also if the restriction in the use or disposal of the item results from a decision or judgment of a competent authority.
  30. Order - the Buyer's declaration of intent made through the Store, clearly specifying: the type and quantity of products; type of delivery; payment method; the place of delivery of the goods, the Buyer's data and aiming directly at concluding the contract between the Buyer and the Seller.
  31. Inclusion - a foreign body embedded in a mineral during the process of crystallization of this mineral; an infix, which is a unique, natural, organic character of the stone. A distinguishing feature does not constitute a flaw/defect in terms of art. 29 of the following regulations.
  32. Wafer - a foreign object embedded in a mineral, usually a fine crystal of another mineral, representing the unique, natural, organic character of the stone. A distinguishing feature does not constitute a flaw/defect in terms of art. 29 of the following regulations.
  33. Elfjoy jewelry - product listed on the product card, which may be the subject of the contract.

 §3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, the following is needed:
    1. Device with internet connection,
    2. Internet browser supporting the JavaScript and Cookies
  2. In order to create an order in the Store, besides the requirements listed in point 1., it is necessary, to have a valid and functioning e-mail account.

§4 TERMS OF SALE

  1. The Product prices visible on the Product Page are wholesome prices for the item.
  2. The Seller points out that the total price of the order consists of the price indicated in the Cart: the price for the goods and, if applicable, the costs of delivery of the goods.
  3. The goods selected for purchase should be added to the Cart in the Store.
  4. Then the Buyer selects from the available in the Store: the method of delivery of the goods and the method of payment for the order, and also provides the data necessary to complete the order.
  5. The order is placed upon confirmation of its content and acceptance of the Terms and Conditions by the Buyer.
  6. Placing an order is tantamount to concluding a sales contract between the Buyer and the Seller.
  7. The Seller shall provide the Privileged Buyer with the confirmation of the conclusion of the sales contract on a durable medium, at the latest, upon delivery of the goods.
  8. The Buyer may register in the Store, i.e. create an Account in it, or make purchases without registration by providing his data with each order.
  9. The stones used to create Elfjoy jewelry are natural and have organic inclusions, "feathers", ingrowths, their internal structure may change color under the influence of different mineral compositions - these features affect the uniqueness of the stones, the unique character of the jewelry, they are its distinguishing feature and do not constitute a defect.
  10. Elfjoy jewelry is usually made in single pieces from unique, natural stones, therefore despite the patterns of some products being repetitive, the stones may be slightly different. The rings presented on the website have an individual character - they are made as single pieces to special orders - the photos are only a stencil for the final product, unless specifies otherwise.
  11. Elfjoy jewelry is delicate and due to the nature of the stones it is not suitable for storage in an environment with high temperatures, and also in full sun exposure - the stones may become discolored, which is their natural feature. Due to the sensitivity of the materials used to create Elfjoy jewelry, it is recommended to avoid any contact of the Elfjoy jewelry with chemicals, perfume, chlorine and water, and to store them in such a way that the stones are not rubbed or damaged by other jewelry elements. 

§5 PAYMENT

  1. For the placed Order, you can pay depending on the Buyer's choice: (a) by ordinary transfer to the Seller's bank account; (b) via the payment platform: PayPal, PayU, Blik, Przelewy24, Google Pay, Apple Pay, Braintree.
  2. All prices quoted by the Seller on the elfjoy website in the English language version are expressed in the Euro currency and are gross prices (including VAT). Product prices do not include the cost of delivery, which is specified in the "delivery" tab.
  3. If the Buyer selects payment in advance, the order must be paid within 7 Business Days of placing the order.
  4. The Seller informs that in the case of some payment methods, due to their specificity, payment for the order by this method is possible only immediately after placing the order.
  5. By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The buyer has the right to withdraw his acceptance for this method of invoice delivery.

§6 ORDER EXECUTION

  1. The Seller is obliged to deliver the goods without defects.
  2. The order fulfillment date is indicated in the Store.
  3. All deadlines are calculated in accordance with Art. 111 of the Civil Code, i.e. the period marked in a days end with the end of the last day, and if the beginning of the period marked in days is a holiday, it is not taken into account when calculating the date of the day on which the holiday occurred.
  4. The Seller will start processing the order after the payment is credited to the Seller's account.
  5. In a situation where, under one order, the Buyer has purchased goods with different delivery dates, the order will be processed within the time limit applicable to the goods with the longest delivery date.
  6. Countries to which shipping is available:
    1. Poland;
    2. All countries of the European Union;
    3. Additional countries listed in the “delivery” tab in the Store;
  7. Goods purchased (products) in the Store are delivered depending on the method of delivery chosen by the Buyer, always via a courier company.
  8. The Buyer may collect the Products in person at the company's premises during its opening hours.
  9. If the Buyer selects the delivery method as “personal collection” within the physical store at Tamka 36, 00-255 Warsaw, Poland, the goods will be ready for pick up at the indicated date in the Contract, and if the Seller has indicated the date of shipment of the goods - on this date.
  10. The price of delivery of international shipments in the "delivery" tab covers the courier's cost and the handling fee for preparing the shipment for international shipment.
  11. In case the Buyer is choosing to ship the order abroad, to a country outside the European Union, the Buyer is obliged to cover any additional charges resulting from the shipment, such as duties, taxes and any other fees that may arise.

§7 THE RIGHT TO WITHDRAW FROM THE CONTRACT

  1. The Preferential Buyer has the right to withdraw from the contract concluded with the Seller via the Store, subject to §8 of the Regulations, within 14 days without giving any reason.
  2. The deadline to withdraw from the contract will expire within 14 days from the day (a) on which the Privileged Buyer acquires, or a third party other than the courier and indicated by the Privileged Buyer becomes in physical possession of the goods; (b) on which the Privileged Buyer acquires the last item or on which a third party, other than the courier and indicated by the Privileged Buyer, acquires the last item in the case of a contract obliging to transfer the ownership of many items that are delivered separately.
  3. In order for the Privilaged Buyer to be able to exercise the right to withdraw from the contract, he must inform the Seller, using the data provided in §2 of the Terms and Conditions, about his decision to withdraw from the contract by an unequivocal statement (e.g. a letter sent by post or information sent by e-mail).
  4. A Privileged Buyer may use the withdrawal form provided here.
  5. To meet the deadline for withdrawing from the contract, it is sufficient for the Privileged Buyer to send information regarding the exercise of his right to withdraw from the contract before the deadline for withdrawing from the contract is up.

    EFFECTS OF WITHDRAWING FROM THE CONTRACT

  6. In the event of withdrawal from the concluded contract, the Seller shall return to the Privileged Buyer the payments received from for the purchased products, immediately, and in any case not later than 14 days from the date on which the Seller was informed about the Privileged Buyer's decision to exercise the right to withdraw from the contract.
  7. The reimbursement will be made by the Seller using the same payment methods that were used by the Preferential Buyer in the original transaction, unless the Preferred Buyer agrees to a different solution, in each case the Preferential Buyer will not incur any fees in connection with this reimbursement.
  8. The Seller may withhold the reimbursement until the return of the goods.
  9. The seller asks the Buyer to return the goods to the following address: Tamka 36 Street, 00-355 Warsaw, Poland, immediately, and in any case not later than 14 days from the date on which the Privileged Buyer informed the Seller about the withdrawal from the sales contract, by courier in an insured shipment. The deadline is met if the Privileged Buyer sends back the goods before the expiry of the 14-day period.
  10. The Privileged Buyer bears the direct costs of returning the goods to the Store.
  11. The Privileged Buyer is responsible only for the decrease in the value of the goods resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the goods. 

§8 EXCEPTIONS TO THE RIGHT TO WITHDRAWL FROM THE CONTRACT

  1. The right to withdraw from a contract concluded from a distance, referred to in §7 of the Terms and Conditions does not apply to the contract:
    1. in which the subject of the service is a non-prefabricated item, manufactured according to the specification of the Buyer or serving to satisfy his individual needs;
    2. in which the subject of the service is an item that deteriorates quickly or has a short shelf-life;
    3. in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging has been opened after delivery;
    4. in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items;
    5. in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery;
    6. for the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts;
    7. in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline to withdraw from the contract.
  2. It is not possible to return Products made to order that meet the individual needs of the Buyer. Changing the size of a ring and any changes to the finished products introduced at the Buyer’s request count as custom-made products and are also non-returnable (this also applies to changes in the length of the bracelet, necklace, etc.) 

§9 COMPLAINTS

  1. In the event of a defect in the goods, the Buyer may complain about the defective goods on the basis of the warranty or guarantee provided for in the Civil Code, provided that the guarantee has been granted.
  2. Using the warranty, the Buyer may, on the terms set out in the Civil Code:submit a declaration of price reduction,with a significant defect - submit a statement of withdrawal from the contract,require that the item be replaced with one that is free from defects,demand that the defect be removed.
  3. The Seller is liable under the warranty if a physical defect is found within two years from the date of delivery of the item to the Buyer - on the terms specified in the Civil Code.
  4. Pursuant to the Civil Code, the Buyer who is an entrepreneur other than the Privileged Entrepreneur loses the rights under the warranty if he did not inspect the item in time and in the manner adopted for such items and did not immediately notify the Seller about the defect, and if the defect only came to light later - if he did not notify the Seller immediately after its finding.
  5. The Seller asks for submitting a complaint under the warranty to the postal or electronic address indicated in § 2 of the Regulations.
  6. If it turns out that in order to consider the complaint, it is necessary to deliver the defective goods to the Seller, the Buyer is obliged to deliver the goods to the address: ul. Tamka 36, 00-355 Warsaw, Poland.
  7. If the product has been granted an additional warranty, information about it, as well as about its conditions, is available in the product description in the Store.
  8. Complaints regarding the operation of the Store should be sent to the e-mail address indicated in §2 of the Regulations.
  9. Consideration of the complaint by the Seller and a reply will take place within 14 days
    EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS
  10. In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, inter alia, with:
    1. mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which you should apply for mediation. As a rule, the procedure is free of charge. The list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
    2. assistance of the competent field of permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which an application should be submitted for consideration of the case before the arbitration court.     3. free help from the municipal or poviat Consumer Spokesman;

§10 PERSONAL DATA

  1. The Administrator of all personal data provided by the Buyer when using the Store is the Seller. Detailed information on the processing of personal data by the Seller - including other purposes and grounds for data processing, as well as data recipients - can be found in the Privacy Policy available in the Store - due to the principle of transparency, contained in the general regulation of the European Parliament and of the Council (EU ) on data protection - "GDPR".
  2. The purpose of processing the Buyer's data by the Seller, provided by the Buyer in connection with purchases in the Store, is the execution of orders. The basis for the processing of personal data in this case is:
    1. for a contract or actions taken at the request of the Buyer, aimed at its conclusion (Article 6 (1) (b) of the GDPR),
    2. the legal obligation on the Seller related to accounting (Article 6 (1) (c) of the GDPR) and
    3. for the legitimate interest of the Seller, consisting in the processing of data in order to establish, assert or defend any claims (Article 6 (1) (f) of the GDPR)
  3. Providing the data by the Buyer is voluntary, but at the same time necessary to conclude the contract. Failure to provide data will prevent the conclusion of a contract in the Store.
  4. The Buyer's data provided in connection with purchases in the Store will be processed until:
    1. the contract concluded between the Buyer and the Seller will cease to apply;
    2. the Seller will cease to have a legal obligation to process the Buyer's data;
    3. the possibility of pursuing claims by the Buyer or the Seller related to the contract concluded by the Store will cease;
    4. The Buyer's objection to the processing of his personal data will be accepted - if the basis for data processing was the legitimate interest of the Seller– depending on what is applicable in a given case and what will happen at the latest. 
  5. The Buyer has the right to request access to his personal data,
    1. to correct them,
    2. for removal,
    3. for processing restrictions,
    4. transferring data to another administrator as well as the law;
    5. to object at any time to the processing of data for reasons related to the specific situation of the Buyer - to the processing of personal data concerning him, based on art. 6 sec. 1 lit. f GDPR (i.e. on the legitimate interests pursued by the administrator). 
  6. In order to exercise his rights, the Buyer should contact the Seller using the data provided in § 2 of the Terms and Conditions.
  7. If the Buyer considers that his data is being processed unlawfully, the Buyer may submit a complaint to the President of the Personal Data Protection Office. 

§11 STRICTURE

  1. The Buyer is forbidden to provide illegal content to the Seller.
  2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Regulations. The contract is concluded on time and for the purpose of order fulfillment.
  3. Agreements concluded on the basis of the Regulations are concluded in Polish in the Polish language version of the website and in English in the English language version of the website.
  4. In the event of a possible dispute with a Buyer who is not a Privileged Buyer, the competent court will be the court competent for the seat of the Seller.

§3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, the following is needed:
    1. Device with internet connection;
    2. Internet browser supporting the JavaScript and Cookies;
    3. Active and valid e-mail account;
    4. 4 Account;
  2. Creating an Account is completely voluntary and depends on the will of the Buyer.
  3. The account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of the order or editing the Buyer's data.
  4. In order to create an Account, complete the appropriate form in the Store.
  5. At the time of creating the Account, an agreement is concluded for an indefinite period between the Buyer and the Seller in the scope of keeping the Account on the terms specified in the Terms and Conditions.
  6. The Buyer may delete the Account at any time without incurring any costs.
  7. In order to delete the Account, please send your resignation to the Seller at the following e-mail address: shop@elfjoy.com, which will result in the immediate deletion of the Account and termination of the Account maintenance contract. 

§5 COMPLAINTS

  1. Complaints regarding the operation of the Account should be sent to the e-mail address: shop@elfjoy.com.
  2. Consideration of the complaint by the Seller and a reply will take place within 14 days.
    EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND PURSUING CLAIMS
  3. In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, inter alia, with:

    2. assistance of the competent field of permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which an application should be submitted for consideration of the case before the arbitration court. §6 PERSONAL DATA

  1. The Administrator of the personal data provided by the Buyer when using the Account is the Seller. Detailed information on the processing of personal data by the Seller - including other purposes and grounds for data processing, as well as data recipients, can be found in the Privacy Policy available in the Store - due to the principle of transparency, contained in the general regulation of the European Parliament and of the Council (EU ) on data protection - "GDPR".
  2. The purpose of processing the Buyer's data is to keep an Account. The basis for the processing of personal data in this case is a contract for the provision of a service or actions taken at the request of the Buyer, aimed at its conclusion (Article 6 (1) (b) of the GDPR), as well as the Seller's legitimate interest in processing data in order to establish , investigating or defending any claims (Article 6 (1) (f) of the GDPR).
  3. Providing data by the Buyer is voluntary, but at the same time necessary for keeping the Account. Failure to provide data means that the Seller will not be able to provide the Account management service.
  4. The Buyer's data will be processed until:
    1. The account will be deleted by the Buyer or the Seller at the Buyer's request
    2. the possibility of pursuing claims by the Buyer or the Seller related to the Account will cease;
    3. The Buyer's objection to the processing of his personal data will be accepted - if the basis for data processing was the legitimate interest of the Seller - depending on what is applicable in a given case and what will take place at the latest.
  5. The Buyer has the right to demand:
    1. access to your personal data,
    2. correct them,
    3. removal,
    4. processing restrictions,
    5. transferring data to another administratoras well as the law:
    6. object at any time to the processing of data for reasons related to the specific situation of the Buyer - to the processing of personal data concerning him, based on art. 6 sec. 1 lit. of GDPR (i.e. on the legitimate interests pursued by the administrator).
  6. In order to exercise his rights, the Buyer should contact the Seller.
  7. If the Buyer considers that his data is being processed unlawfully, the Buyer may submit a complaint to the President of the Personal Data Protection Office. 

§7 STRICTURE

  1. The Buyer is forbidden to provide illegal content to the Seller.
  2. The Account maintenance agreement is concluded in Polish in the English language version of the website.
  3. In the event of important reasons referred to in sec. 4, the Seller has the right to amend the Terms and Conditions.
  4. Important reasons referred to in sec. 3 are:
    1. the need to adapt the Store to the legal provisions applicable to the Store's operations;
    2. improving the safety of the service provided;
    3. a change in the functionality of the Account that requires modification of the Regulations;
  5. The Buyer will be informed about the planned amendment to the Regulations at least 7 days before the change is implemented via an e-mail sent to the address assigned to the Account.
  6. If the Buyer does not accept the planned change, he should inform the Seller about it by sending an appropriate message to the Seller's e-mail address shop@elfjoy.com, which will result in the termination of the Account maintenance agreement upon the entry into force of the planned change or earlier, if requested by the Buyer.
  7. If the Buyer does not object to the planned change until its entry into force, it is assumed that he accepts it, which does not constitute as an obstacle to terminate of the contract in the future.
  8. In the event of a possible dispute with a Buyer who is not a privileged Buyer, the competent court will be the court competent for the seat of the Seller.
